These Terms of Service ("Terms") govern your access to and use of the Smart Scanner website, mobile application, and related services (collectively, the "Services"). By using the Services, you agree to these Terms.

1. Eligibility

You must be legally capable of entering into a binding agreement in your jurisdiction to use the Services. If you use the Services for an organization, you represent that you have authority to bind that organization.

2. Services

Smart Scanner may provide features such as AI image generation, smart captions, photo-based document digitization, OCR-related extraction, object recognition, and related analysis tools.

3. User Content

You may submit photos, images, files, prompts, text, and other materials through the Services ("User Content"). You retain ownership of your User Content.

By using the Services, you grant Smart Scanner a limited, non-exclusive, worldwide license to host, process, reproduce, modify, analyze, and transmit User Content only as needed to operate, secure, maintain, improve, and provide the Services in accordance with the Privacy Policy.

4. Acceptable Use

  • Do not use the Services in violation of law or regulation;
  • Do not upload harmful, unlawful, infringing, deceptive, abusive, or malicious content;
  • Do not attempt to interfere with platform integrity or security;
  • Do not misuse AI outputs for harmful, fraudulent, or deceptive purposes;
  • Do not violate the privacy or intellectual property rights of others.

5. AI Output Disclaimer

AI-generated or automated outputs may be incomplete, inaccurate, or unsuitable for your intended purpose. You are responsible for reviewing outputs before relying on or sharing them.

6. Intellectual Property

Except for User Content and rights expressly granted to you, Smart Scanner and its licensors retain all rights, title, and interest in and to the Services, including software, branding, interface design, and related materials.

7. Service Availability

We may update, suspend, restrict, or discontinue any feature at any time. We do not guarantee uninterrupted or error-free availability.

8. Suspension or Termination

We may suspend or terminate access if we believe you violated these Terms, created legal risk, or threatened the security or integrity of the Services.

9. Disclaimer of Warranties

THE SERVICES ARE PROVIDED IS AVAILABLE TO THE MAXIMUM EXTENT PERMITTED BY LAW, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SMART SCANNER SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS OPPORTUNITY.

11. Governing Law

These Terms are governed by the laws of DRC, without regard to conflict of law principles.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect means you accept the updated Terms.
